Welcome to PumplAI! These Terms of Service ("Terms") govern your use of the PumplAI platform, website, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using PumplAI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our Service.

You must be at least 16 years old to use PumplAI. By using our Service, you represent that you meet this age requirement.

2. Description of Service

PumplAI provides an AI-powered fitness coaching platform that includes:

  • Personalized workout programming and recommendations
  • Real-time exercise form analysis and feedback
  • Progress tracking and fitness analytics
  • Connection with personal trainers (Trainer tier)
  • Educational fitness content and resources

3. User Accounts

3.1 Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use at security@pumpl.app.

4. User Responsibilities

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code, viruses, or harmful content
  • Harass, abuse, or harm other users
  • Share your account credentials with others
  • Use automated systems to access the Service without permission
  • Reverse engineer or attempt to extract source code

4.2 Health Disclaimer

Important: PumplAI is not a substitute for professional medical advice, diagnosis, or treatment. Always consult with a qualified healthcare provider before starting any exercise program, especially if you have pre-existing health conditions.

You acknowledge that physical exercise carries inherent risks and agree that you participate in workouts at your own risk. If you experience pain, dizziness, or discomfort during exercise, stop immediately and seek medical attention.

5. Subscription and Payments

5.1 Subscription Plans

PumplAI offers various subscription tiers with different features and pricing. Detailed pricing information is available on our Pricing page.

5.2 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable except as expressly stated
  • We may change pricing with 30 days' notice
  • Failed payments may result in service suspension

5.3 Free Trials

We may offer free trials. At the end of the trial, your subscription will automatically convert to a paid plan unless you cancel before the trial ends.

5.4 Refund Policy

We offer a 30-day money-back guarantee for first-time subscribers. After 30 days, refunds are at our sole discretion. To request a refund, contact support@pumpl.app.

6. Intellectual Property

6.1 Our Content

The Service, including its design, text, graphics, logos, icons, images, audio clips, software, and other content, is owned by PumplAI or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6.2 Your Content

You retain ownership of content you submit (workout logs, photos, feedback). By submitting content, you grant PumplAI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content solely to provide and improve the Service.

6.3 AI-Generated Content

Workout plans and recommendations generated by our AI are provided for your personal use within the Service. You may not resell or commercially distribute AI-generated content.

7. Trainers and Third Parties

7.1 Trainer Services

If you connect with a personal trainer through PumplAI, the trainer is an independent professional, not an employee of PumplAI. We do not guarantee the quality, safety, or legality of trainer services.

7.2 Third-Party Links

The Service may contain links to third-party websites. We are not responsible for the content, privacy practices, or availability of third-party sites.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUMPLAI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits, data, or goodwill
  • Service interruption or computer damage
  • Personal injury or property damage
  • Unauthorized access to your data

Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • Results from using the Service will be accurate or reliable
  • The quality of the Service will meet your expectations

10. Indemnification

You agree to indemnify and hold harmless PumplAI and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

11. Termination

11.1 By You

You may terminate your account at any time through your account settings or by contacting support. Upon termination, you lose access to paid features immediately.

11.2 By Us

We may suspend or terminate your account at any time for:

  • Violation of these Terms
  • Suspected fraudulent or illegal activity
  • Non-payment of fees
  • Extended periods of inactivity
  • Any other reason at our sole discretion

11.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes. Sections on Intellectual Property, Limitation of Liability, Indemnification, and Dispute Resolution survive termination.

12. Dispute Resolution

12.1 Informal Resolution

Before filing a formal dispute, you agree to contact us at legal@pumpl.app and attempt to resolve the dispute informally for at least 30 days.

12.2 Arbitration

Any dispute not resolved informally shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English and the decision shall be final and binding.

12.3 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.

15. Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and PumplAI
  • Severability: If any provision is found invalid, the remaining provisions remain in effect
  • No Waiver: Our failure to enforce any right does not waive that right
  • Assignment: You may not assign these Terms; we may assign them freely
